4. Regulation 17 and 18 - Examination and Examiner's Report (May/June 2019)

Regulation 17 - Examination

Following the Regulation 16 consultation, the Addingham Neighbourhood Development Plan has been subject to an independent examination. Andrew Freeman BSc (Hons) DipTP DipEM FRTPI of Intelligent Plans & Examinations (IPE) Ltd was appointed to carry out the independent examination.

The Council sent the plan, supporting information and representations to the examiner. These comments were then taken into account insofar as they related to the remit of the examination. The examination was conducted by written representations.

The examination considered whether the plan meets the basic conditions and other requirements set out in law, in particular whether it:

  • has regard to national policy
  • contributes to the achievement of sustainable development
  • is in general conformity with the adopted strategic policies for the local area
  • is compatible with EU obligations
  • meets human rights requirements.

The examiner issued a letter clarifying a number of initial procedural matters about how he intends to undertake the examination. He has also set out a number of preliminary questions for Addingham Parish Council and City of Bradford Metropolitan District Council. The letter and preliminary questions can be viewed below. The responses, are published on this page.

The Examiner's report has now been received and is published below. The report recommends that the NDP can progress to referendum with some modifications. The report and recommendations will now be considered by the Council's Executive (on the forward plan for September) where a decision will be made on taking it forward to referendum.

Examiner's Report and Plan Proposal Decisions (Regulation 18)

Following the examination of Addingham Neighbourhood Development Plan, it was recommended that, subject to a number of modifications, the plan should move forward to referendum.

The examiner's report and recommendations were considered at the council's Executive meeting on 10 September 2019 and it was decided that the plan should to be put to a referendum.
